Цель: исследовать актуальные вопросы, касающиеся выработки и принятия документов стратегического планирования в области привлечения инвестиций и инвестиционной деятельности.
Методы: использованы общенаучные методы анализа и синтеза, системного и факторного анализа, а также сравнительно-правовой анализ национальных правовых систем России и государств — участников СНГ.
Результат: показано, что привлечение инвестиций требует четкого правого регулирования в национальном законодательстве, в том числе и посредством принятия документов стратегического планирования. Для повышения эффективности правового регулирования в области привлечения инвестиций соответствующие документы стратегического планирования должны быть согласованы и скоррелированы с базовыми законодательными актами в области инвестиций и инвестиционной деятельности, принятыми на национальном уровне правового регулирования, носить непротиворечивый, прогностический и научный характер, учитывать совокупность факторов, определяющих мировые и национальные тенденции развития экономики. В статье проанализирован опыт государств СНГ в рассматриваемой сфере, а также показан положительный опыт Республики Таджикистан и Республики Казахстан, где приняты соответственно Стратегия привлечения инвестиций в Республику Таджикистан на период до 2040 года и Концепция инвестиционной политики Республики Казахстан до 2030 года, в плане возможного учета в российских условиях. В статье рассмотрены также актуальные направления административно-правового обеспечения повышения эффективности инвестиций и инвестиционной деятельности.
Objective: Attracting investments is an essential component of state economic and investment policy, which allows for the creation of conditions for the successful implementation of national development goals and priorities, ensuring sustainable economic growth and increasing the competitiveness of the national economy, building up infrastructure and industrial potential, and promoting balanced and comprehensive regional development, as well as human development. The author aims to analyze the national legislation of Russia and the CIS member states to explore relevant issues related to the development and adoption of strategic planning documents in the field of investment attraction and investment activities.
Method: In the course of the study, general scientific methods of analysis and synthesis, as well as systemic and factorial analysis, were used based on the dialectical method. Special attention was paid to the comparative legal analysis of the national legal systems of Russia and the CIS member states, which allowed for the identification of gaps that needed to be filled through the adoption of relevant strategic planning documents in the field of investment attraction.
Result: It has been shown that attracting investment requires clear legal regulation in national legislation, including through the adoption of strategic planning documents. To improve the effectiveness of legal regulation in the field of investment attraction, relevant strategic planning documents should be coordinated and correlated with the basic legislative acts on investment and investment activities adopted at the national level of legal regulation, and should be consistent, predictive, and scientific, taking into account a combination of factors that determine global and national economic development trends. The article analyzes the experience of the CIS countries in this area, and also shows the positive experience of the Republic of Tajikistan and the Republic of Kazakhstan, where the Strategy for Attracting Investments to the Republic of Tajikistan for the period up to 2040 and the Concept of the Investment Policy of the Republic of Kazakhstan for the period up to 2030 have been adopted, respectively. The article also discusses current areas of administrative and legal support for increasing the efficiency of investments and investment activities.
