<p>Цель работы состоит в анализе и разработке комплексного подхода к решению этических и правовых аспектов, возникающих при внедрении технологий искусственного интеллекта (ИИ) в системы кибербезопасности, а также в формулировании рекомендаций по адаптации законодательства для минимизации рисков автономного принятия решений.</p><p>Метод исследования базируется на комплексном междисциплинарном подходе, объединяющем методы сравнительно-правового анализа и этической экспертизы. В первой части работы применяется метод критического анализа для выявления этических проблем, таких как непрозрачность алгоритмов и предвзятость моделей, ведущая к дискриминации. Основная часть исследования построена на сравнительно-правовом методе: проведен детальный разбор нормативных подходов Европейского союза, Китая, Индии и Российской Федерации, включая анализ Национальной стратегии развития ИИ и законопроекта об уголовной ответственности. Завершается исследование применением метода правового моделирования для разработки предложений по модификации законодательства.</p><p>Результаты исследования позволили выявить ключевое противоречие: двойственная природа ИИ в кибербезопасности, выступающего одновременно инструментом защиты и источником новых уязвимостей. В ходе анализа установлено, что главными этическими проблемами остаются скрытость алгоритмов и конфликт между глубиной защиты и приватностью пользователей. В правовой плоскости зафиксирована нехватка единых стандартов определения ИИ и сложность с присвоением ответственности за ошибочные решения алгоритмов. Особое внимание уделено критике российским профессиональным сообществом проекта о введении уголовной ответственности, указывающей на риски излишней криминализации отрасли. В итоге исследования разработаны практические рекомендации: предложены варианты преодоления этических проблем через обеспечение прозрачности систем и даны предложения по модификации законодательства, необходимые для ответственного внедрения ИИ в критически важную инфраструктуру, что позволит снизить правовые риски для разработчиков и операторов систем.</p>

<trans-abstract xml:lang="en">
<p>The purpose of the work is to analyze and develop an integrated approach to solving ethical and legal aspects arising from the introduction of artificial intelligence technologies into cybersecurity systems, as well as to formulate recommendations for adapting legislation to minimize the risks of autonomous decision-making.</p><p>The research method is based on a comprehensive interdisciplinary approach that combines the methods of comparative legal analysis and ethical expertise. The first part of the paper uses the method of critical analysis to identify ethical problems, such as the opacity of algorithms and model bias leading to discrimination. The main part of the study is based on the comparative legal method: a detailed analysis of the regulatory approaches of the European Union, China, India and the Russian Federation, including the analysis of the National Strategy for the Development of AI and the draft law on criminal liability, is carried out. The study ends with the application of the method of legal modeling for the development of proposals for the modification of legislation.</p><p>The results of the study revealed a key contradiction: the dual nature of AI in cybersecurity, which is both a defense tool and a source of new vulnerabilities. The analysis found that the main ethical problems remain the secrecy of algorithms and the conflict between the depth of protection and user privacy. In the legal plane, the lack of uniform standards for defining AI and the difficulty in assigning responsibility for erroneous decisions of algorithms are recorded. Particular attention is paid to the criticism by the Russian professional community of the project on the introduction of criminal liability, indicating the risks of excessive criminalization of the industry. As a result of the study, practical recommendations were developed: options for overcoming ethical problems by ensuring the transparency of systems were proposed, and proposals were given for modifying the legislation necessary for the responsible implementation of AI in critical infrastructure, which will reduce legal risks for system developers and operators.</p>
