Методы: формально-юридический анализ судебных актов высших инстанций (Верховного Суда РФ, Суда по интеллектуальным правам, Высшего Арбитражного Суда РФ) за период 2024-2026 годов, включая Обзор ВС РФ от 29 мая 2024 г.; сравнительно-правовой метод для сопоставления российского регулирования с подходами Европейского Союза (Директива об электронной торговле, Директива 2019/790, Digital Services Act), США (DMCA) и Китая (Закон об электронной коммерции 2018 г.); метод системного толкования правовых норм в их взаимосвязи с доктринальными позициями и разъяснениями Пленума ВС РФ.
Результаты: проведённый анализ позволил установить пять устоявшихся критериев отграничения информационного посредника от непосредственного нарушителя (отсутствие инициативы и контроля над содержанием; получение дохода исключительно от технических услуг, а не от использования объектов интеллектуальных прав; роль посредника в формировании материала; бремя доказывания статуса посредника на владельце сайта; техническая возможность контроля). Выявлено, что отсутствие легальной дефиниции информационного посредника и законодательно закреплённого перечня необходимых и достаточных мер сохраняет правовую неопределённость, снижая предсказуемость правоприменения. Сформулированы конкретные предложения de lege ferenda: закрепление легального определения на основе критериев отсутствия формирования контента и неполучения прямой выгоды от нарушения; установление минимального стандарта мер реагирования для разных видов посредников; имплементация элементов проактивного подхода Китая (обязанность проверки продавцов, технологическое предупреждение нарушений). На основе сравнительного анализа обосновано, что российское регулирование ближе к европейской модели «безопасной гавани», однако уступает в детализации мер и предсказуемости правоприменения.
Научная новизна: впервые на основе систематического анализа судебной практики 2024-2026 годов (включая дела «СТАМО ТУЛС», «Бесогон», «ВК» и др.) предложен комплексный подход к квалификации информационного посредника, интегрирующий функциональные критерии, выработанные высшими судебными инстанциями, с элементами проактивного регулирования. Обоснована необходимость отказа от трёхчастной классификации в пользу единой дефиниции, учитывающей степень контроля посредника над контентом и характер получаемой выгоды. Впервые предложено закрепить в законодательстве возможность передачи права администрирования доменного имени добросовестному правообладателю как меру защиты от недобросовестной регистрации доменов.
Практическая значимость: предложенные материалы могут быть использованы в законотворческой деятельности при совершенствовании ст. 1253.1 ГК РФ, в судебной практике для унификации подходов к освобождению информационных посредников от ответственности, а также в локальных регламентах маркетплейсов и онлайн-платформ при внедрении процедур оперативного реагирования на жалобы правообладателей и профилактики повторных нарушений.

Objective. The aim of the study is to analyze and systematize the criteria for qualifying the activities of an information intermediary, as well as to determine the limits of his civil liability under Article 1253.1 of the Civil Code of the Russian Federation, taking into account doctrinal approaches and public-law aspects of law enforcement, including the role of higher judicial instances and the prospects for legislative regulation.
Methods. The research is based on a formal legal analysis of judicial acts of higher courts (the Supreme Court of the Russian Federation, the Intellectual Property Court, the Supreme Arbitration Court of the Russian Federation) for the period 2024-2026, including the Review of the Supreme Court of the Russian Federation of May 29, 2024. A comparative legal method is used to juxtapose Russian regulation with the approaches of the European Union (the E-Commerce Directive, Directive 2019/790, the Digital Services Act), the United States (the Digital Millennium Copyright Act), and China (the E-Commerce Law of 2018). The method of systematic interpretation of legal norms is applied in their interrelation with doctrinal positions and clarifications of the Plenum of the Supreme Court of the Russian Federation.
Results. The analysis has established five well-established criteria for distinguishing an information intermediary from a direct infringer: absence of initiative and control over content; receipt of income exclusively from technical services rather than from the use of intellectual property rights; the intermediary’s role in forming the material; burden of proving intermediary status resting on the website owner; technical feasibility of control. It is revealed that the lack of a statutory definition of an information intermediary and a legislatively approved list of necessary and sufficient measures perpetuates legal uncertainty, reducing the predictability of law enforcement. Specific proposals de lege ferenda are formulated: enshrining a legal definition based on the criteria of non-creation of content and non-receipt of direct benefit from the infringement; establishing a minimum standard of response measures for different types of intermediaries; implementing elements of China’s proactive approach (obligation to verify sellers, technological prevention of infringements). Based on a comparative analysis, it is substantiated that Russian regulation is closer to the European “safe harbor” model, but is inferior in terms of the detail of measures and predictability of law enforcement.
Scientific novelty. For the first time, based on a systematic analysis of judicial practice for 2024-2026 (including the “STAMO TULS”, “Besogon”, “VK” cases, and others), a comprehensive approach to the qualification of an information intermediary is proposed, integrating functional criteria developed by higher judicial instances with elements of proactive regulation. The necessity of abandoning the three-part classification in favor of a unified definition that takes into account the degree of the intermediary’s control over content and the nature of the benefit received is substantiated. For the first time, it is proposed to legislate the possibility of transferring the right to administer a domain name to a bona fide rights holder as a measure of protection against bad-faith domain registration.
Practical significance. The proposed materials can be used in legislative activity when improving Article 1253.1 of the Civil Code of the Russian Federation, in judicial practice for unifying approaches to exempting information intermediaries from liability, as well as in local regulations of marketplaces and online platforms when implementing procedures for prompt response to complaints from rights holders and prevention of repeated infringements.
